Independent Evaluation is a highly efficient and pragmatic process which culminates with a one-day evaluation conducted face to face by one of our highly experienced Evaluators. Prior to the evaluation, the Evaluator crystallises issues and begins the forensic assessment of the strengths and weaknesses of the parties’ positions. On the day itself, the Evaluator talks each party through the issues, explains the probable outcome if the matter were to proceed through the courts and sets out the proposed resolution. The Evaluator then works with those involved to facilitate the optimal settlement for both sides. By the end of the day, all issues in the case are resolved, including those relating to costs. Highly successful track record
At Independent Evaluation, or IE as we are known, we have established a reputation as trusted providers of efficient and rapid justice, settling claims all over the country. Although IE is non-binding and parties are free to reject the evaluation and the proposed resolution, no one has yet done so.
Bespoke Evaluations
We are also able to create bespoke evaluations to meet the demands of unusually difficult disputes. For instance, we have developed a bespoke model for hospital disputes relating to the treatment of critically and terminally ill patients. Specifically for ‘Best Interests’ and Intensive Care (ICU) disputes, we have adapted the IE process with the addition of a second Evaluator with specialist ICU Consultant experience, so that difficult cases of this nature are evaluated by a unique combination of top, independent legal AND medical experts, rather than relying purely on legal expertise.
